MP HC Asks Sexual Assault Accused To Get Rakhi Tied By Victim To Get Bail, SC Rejects It

Off late, we have been coming across some bizarre rulings made by the courts of all. From the Bombay HC ruling that groping a minor’s breast without skin-to-skin contact cannot be deemed as sexual assault under the POSCO act to the Supreme Court asking a rape accused to marry the victim, such instances involving our judicial system has left several people shocked.

However, in a fortunate turn of events, the Supreme Court has rejected an order given by the Madhya Pradesh High Court to a sexual assault accused wherein they asked him to get a rakhi tied by the victim if he wants to be granted bail, reports NDTV.

A man named Vikram Bagri, who was in jail for sexual assault charges, had applied for bail in April 2020. On July 30, the Madhya Pradesh HC granted him conditional bail – one of the conditions was that he would visit the victim’s home and get a Rakhi tied by her on Rakshabandhan.

He was also asked to “protect the woman as a brother” and give her Rs 11,000.

According to TOI, a plea was filed by 9 women lawyers against the conditional bail. They had highlighted how the bail condition leads to the “victimisation of the survivor in her own house” and amounts to the “gross trivialisation of the trauma suffered by the complainant.”

Listening to the plea, the Supreme Court quashed the MP HC’s order for conditional bail and called for the “sensitisation of judges and lawyers”.
