Delhi High Court Says That A Husband Can Divorce Wife If She Refuses Sex For Long Time

The Delhi High Court has taken a step that will change the nature of marriages and divorces in the country. With regard to a running case of marital dispute, this ruling came as a statement from the High Court about cases like this.

The Delhi High Court gave a verdict that the denial of sexual consent by a wife to her husband is equivalent to mental cruelty. The decision came on a petition by a husband seeking the divorce because his wife restrained physical relations for four and a half years.

“In view the foregoing discussion, we are of the considered view that the husband has fully established that he was subjected to mental cruelty by the wife by denying sex to him for a long period despite living under the same roof, without any justification and though she was not suffering from any physical disability. “

 

The man claimed that when her conduct became unbearable, his parents asked them to live in a separate accommodation in another portion of the same house.

“The appeal being well founded deserves to be allowed,” it said, adding “we grant a decree of divorce in favour of the husband on the ground of cruelty by dissolving his marriage with the wife that had been solemnised”.

They were married since 2001, residing in Haryana and have two kids aged 8 and 9.

Shouldn’t this law be applicable on both sexes, though?
