Oral talaq, instant divorce or talaq-e-biddat. Called by many names, it is essentially a Muslim man’s right to say the Arabic word ‘talaq’ three times to his wife to obtain a divorce. Almost two years ago the Indian Supreme Court had declared the practise unconstitutional and last week the Lok Sabha passed the Muslim Women (Protection of Rights on Marriage) Bill that sought to make it void and illegal.
The Times of India reports that the bill was passed by the Rajya Sabha yesterday with 99-84 votes. It makes triple talaq a criminal offence with a punishment of up to three years in jail.

Now the bill will go to the President and become law after being signed by him. When the news broke, people across the country started hailing the historic moment and activists who fought for this move heaved a huge sigh of relief. The nation is slowly but steadily doing away with discriminatory practices and striking down laws like Section 377.

It is heartening to know that no woman has to ever face the ‘triple talaq’ again and on the off-chance that it happens, she would have legal recourse against it.
