Fake Bihar intermediate topper, Ruby Rai, was arrested on Saturday after failing the re-test and the reasons behind her arrest still remain unclear. Ruby Rai, who is now a hardened criminal in eyes of law has been taken under custody without her age being verified.
Non-bailable arrest warrants have been issued by the Patna Civil Court against four toppers including Ruby Rai.
The secretary-cum-principal of Bishun Rai College, Bacha Rai, considered the kingpin of the scandal had been arrested on June 11. On June 15, warrants had been issued against Bihar School Examination Board chairman Lalkeshwar Prasad Singh as well as his wife, MLA Usha Sinha in connection to the topper scandal along 20 other arrests and 300 transfers. However, it’s the arrest of 17-year-old Ruby that has called for a debate with several questions raised over.
According to Senior Superintendent of Police Manu Maharaj, it’s Ruby’s responsibility to prove that she’s a juvenile and if proven will be produced before the Juvenile Justice Board.
This, however, contradicts Juvenile Justice Act age determination section which states that an accused is to be given the benefit of doubt by the magistrate in case the age is not determined. While minister of State for HRD has has raised the question, “Why should the students be arrested and sent to jail for the fault of the system, teachers and parents?”, reactions from people all over the country has been rather apprehensive of the arrest.

Ruby Rai, being just another one of the thousands of students taking advantage of the system to bribe their way out of education may just be a scapegoat of what seems to be a summary justice.
